Terms of Service

Last updated: 10 October 2026

1. Agreement

Welcome to MØDUS ("MØDUS", "we", "us"), a booking and coaching platform available at modus.fitness that connects personal trainers ("coaches") with their clients ("athletes"). By creating an account or using MØDUS you agree to these Terms of Service. If you do not agree, please do not use the service. These terms apply to everyone who uses MØDUS, whether as a coach or as an athlete.

2. Accounts

  • You must be at least 13 years old to use MØDUS.
  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • You must give accurate information about yourself and keep it up to date.
  • Coaches are responsible for the accuracy of the services, prices, availability and payment details they publish on their profiles.

We may suspend or close an account that breaches these terms, that we reasonably believe is being used fraudulently, or that puts other users or the service at risk. Where practical we will tell you first.

3. What MØDUS does — and does not do

MØDUS provides tools for coaches to publish their services and availability, and for athletes to book, pay for and manage sessions with those coaches. Sessions themselves (the training) are delivered by the coaches, not by MØDUS.

MØDUS is a software platform. We are not a party to the coaching relationship between coach and athlete, we do not employ or certify coaches, and we do not supervise or guarantee the quality, safety or outcomes of any training. You choose your coach (or your athlete) and deal with each other at your own judgement.

4. Bookings, rescheduling and cancellation

  • A booking is confirmed when the coach accepts it. Before that, the booking is a request.
  • Rescheduling always requires confirmation: a coach cannot unilaterally change a confirmed session. A coach may propose a new time (including by moving the session in a connected calendar), and the session only moves once the athlete accepts or picks a new slot.
  • Either side may cancel a confirmed session that has not yet taken place. Cancellations are final and trigger the notifications, refunds and voucher handling described in the app and in our Privacy Policy.
  • Sessions that have already taken place are marked completed and can no longer be cancelled or rescheduled.
  • Repeated no-shows or abusive cancellation patterns may lead an affected coach, or MØDUS, to refuse future bookings from that account.

5. Payments and vouchers

  • Payments for sessions are made between athlete and coach, using the payment method the coach offers (for example a transfer reference or a code shown in the app).
  • Where the athlete uploads proof of payment, the coach confirms it. MØDUS records payment status but does not process, hold or refund money for direct payments between users.
  • Vouchers and packages are issued by the coach for their own services. A voucher is redeemed for the specific session it is booked with; when a voucher session is cancelled, the voucher is returned so it can be used again.
  • Some coaches offer their gym for rental with a session. The rental fee is shown before you book and is handled together with the session payment between you and the coach.
  • Referral rewards (for example, a free-session voucher when a referred athlete makes their first purchase, or extra trial time when a referred coach confirms their first paid booking) are issued automatically by MØDUS when the qualifying conditions are met. Rewards cannot be self-granted or transferred.
  • We do not set, warrant or guarantee the prices, refund policies or payment practices of coaches. Disputes about payment are between athlete and coach, and we may help by providing booking records to both parties.

6. Your content

You keep ownership of everything you upload or send through MØDUS — session photos and videos, comments, voice notes and messages ("your content").

You grant us only what we need to run the service:

  • Session media and comments are private to you and the people involved in that session (the coach and the athlete for that booking). We do not publish or display them to anyone else.
  • Profile photos, trainer portraits, services and any other content you publish on a page other users can see are shown to those users, as you intended.
  • You confirm you have the rights to the content you upload, and that it does not infringe anyone's rights or break the law.
  • Do not upload content you do not have permission to share, including other people's photos or recordings.
  • Do not upload unlawful, hateful, harassing, sexual, violent or misleading content, or content that invades anyone's privacy.

Messages you send in MØDUS messaging are visible to the people in that conversation. You can edit or delete your own messages: deleting "for everyone" removes the message from the conversation for both sides, while deleting "for me" only hides it on your device. Remember that the other person may have already read a message before you delete it.

We may remove content, or suspend an account, that breaches this section. You can delete your own session media, comments and voice notes from the app at any time.

7. Acceptable use

  • Use MØDUS only for its intended purpose: managing and taking part in coaching sessions.
  • Do not attempt to access other users' data, break the app's security, scrape the service, or interfere with its operation.
  • Do not use another person's identity, or create accounts for anyone other than yourself.
  • Do not spam, harass or send unwanted commercial messages to other users.

8. Calendar integrations (Google Calendar & Apple iCloud)

Coaches may optionally connect one calendar — either Google Calendar or Apple iCloud Calendar, not both at the same time — so that their real availability shows on their booking page, confirmed sessions appear on their calendar, and moves or deletions of MØDUS events in that calendar are reflected in the app. Connecting one calendar replaces the other.

Connecting Apple iCloud requires an app-specific password you create in your Apple Account. You are responsible for creating it and may revoke it at any time; if it is revoked or expires, syncing stops until you enter a new one. Changes made in Apple Calendar are picked up on a regular schedule rather than instantly.

These features are governed by our Privacy Policy, which explains what calendar data is accessed and how it is used. Connecting a calendar is optional and can be disconnected at any time.

9. Availability, changes and errors

  • We work to keep MØDUS available and correct, but the service is provided without any promise that it will be uninterrupted or error-free.
  • Times shown in the app are based on the time zones selected by the coach. Booking times are always the agreed session times between coach and athlete; where a calendar connection is in use, availability may also reflect the coach's other calendar commitments.
  • We may add, change or remove features, and may need short maintenance windows. Material changes that affect you will be communicated in the app or by email.

10. Health disclaimer

Coaching and training involve physical activity and carry a risk of injury. Nothing in MØDUS is medical advice. Athletes should consult a qualified health professional before starting any training programme and are responsible for their own condition, limits and safety during sessions. Coaches are responsible for the professional competence, qualifications and insurance appropriate for the services they offer.

11. Intellectual property

The MØDUS name, logo, design and software are owned by us or our licensors and are protected by law. You may not copy, resell or create a competing product from any part of MØDUS. Nothing in these terms transfers ownership of the service to you.

12. Third-party content and attribution

Exercise data and illustrations in MØDUS are provided by RepDB under the RepDB — Free Tier License (v1.0). Illustrations may be recoloured to match the app's appearance, as the license permits. RepDB is not affiliated with, and does not endorse, MØDUS.

Exercise descriptions and illustrations are general information only and are not medical advice. Follow your coach's guidance, and consult a qualified professional before starting any exercise programme.

13. Disclaimers

To the fullest extent permitted by law, MØDUS is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of availability data, and uninterrupted operation. We do not warrant that other users will honour bookings, pay, behave lawfully, or deliver the sessions they advertise.

14. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim connected with MØDUS is limited to the amount you paid us for use of the service in the 12 months before the claim, or USD 100 if you paid nothing. We are not liable for indirect or consequential losses, lost profits, lost data, or disputes and losses arising between coach and athlete.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be limited.

15. Your responsibility to others

Because MØDUS is a platform between users, you are responsible for your dealings with the coach or athletes you book with. If you bring a claim against another user, you will not involve MØDUS in that claim beyond providing factual booking records.

16. Termination

  • You may stop using MØDUS and request deletion of your account at any time by emailing contact@modus.fitness.
  • We may suspend or terminate your access if you seriously or repeatedly breach these terms, or if we are required to by law.
  • When an account is closed, we handle your data as described in our Privacy Policy.

17. Governing law and disputes

These terms are governed by the laws of Thailand, without regard to conflict-of-law rules. Before starting formal proceedings, please contact us at contact@modus.fitness — most problems can be resolved by talking. Consumers also keep any rights their local consumer protection law gives them, including the right to bring proceedings in their country of residence where applicable law requires it.

18. Changes to these terms

We may update these terms as the service evolves. When we make material changes we will update the date at the top and, where practical, notify you in the app. Continued use of MØDUS after a change takes effect means you accept the updated terms.

19. Contact

Questions about these terms, your account, or a booking: contact@modus.fitness. You can also reach us through the app or at modus.fitness.
